Consultant – Constitutional Expert

Location: remote with a possibility of travel

With over three decades of working in Sudan, an office in Khartoum, and a broad network of relationships across the 18 states, the Carter Center is now working to support Sudan’s ongoing transition. To assist this support, the Carter Center is seeking a highly qualified individual to serve as a Constitutional Expert. The selected candidate will work remotely and report to the Carter Center’s Conflict Resolution Program and Democracy Program Associate Directors.   

Applicants should have at least 10 years of experience working on transitional monitoring within conflict resolution and democratic governance programs with a focus on constitutional drafting and analysis. The ideal candidate would hold a law degree and have experience working in conflict- or post-conflict countries transitioning to a democratic government, as well as strong knowledge of and experience in Sudan. Fluency in English is required; Arabic is highly desirable. The position is expected to be remote-based and conducted primarily through desk review, and, if possible, with field-based engagement depending on program contingencies. The analyst will be part of a core team of researchers who will jointly produce a final report with findings at the end of the consultancy. The initial assignment is for three months, beginning in March 2023.

The Constitutional Expert is responsible for understanding and analysing Sudan’s constitutional development processes and frameworks. S/he will: 

  • Become familiar with the evolving legal and regulatory framework for Sudan’s transitional process including the 2019 Constitutional Charter, Juba Peace Agreement, August 2022 draft constitution, and December 2022 Framework Agreement, as well as any other relevant laws (media regulations, judicial system, electoral procedures, etc.) and international obligations; 
  • Conduct an analysis of the constitutional framework and develop recommendations in the context of relevant national legislation and international obligations for democracy;
  • Monitor and assess preparations and preconditions for the holding of credible elections;
  • Track and assess any evolution of the constitutional drafting processes with an emphasis on the development of the constitutional framework ; collect, review and summarize all constitutional frameworks/laws relevant to Sudan’s democratic transition;  
  • Assess the development and implementation of the constitutional framework in practice, including its agreement with both relevant national legislation and international obligations for democratic systems by:  1) Conducting remote consultations with key decision-making bodies, civil society organizations, and youth; 2) Tracking stakeholder conferences which are taking place as part of the transitional process; 3) Supporting the Youth Citizen Observer Network through thematic analysis to inform regional priorities; 4) Briefing key stakeholders and Carter Center staff as required in coordination with other analysts to share views on relevant legal aspects.
  • Prepare supplemental memos assessing specific constitution-drafting related issues on an “as-needed” basis; Contribute to the preparation of statements of preliminary findings and any of the project’s interim reports;
  • Submit weekly reports on relevant developments as well as to contribute to the writing of a final report with findings due at the end of May 2023, bearing primary responsibility for drafting report sections focused on the legal/constitutional framework; and
  • Perform other duties as appropriate for the good functioning of the project.
